1. INTRODUCTION

1.1.Purple Feather Tree also referred to as ‘PFT’ from time to time provides access to digital courses in the form of online, educational courses, accessible through a members’ area. Purple Feather Tree, is registered Limited Company; Registration Number 08860009.

1.2.When you subscribe to access the information, resources, services, products, and tools we provide, you understand and agree to the following terms and conditions stated in this agreement. The terms contained in this Agreement cover all educational courses and ancillary services that Purple Feather Tree offer.

2. ACCEPTANCE AND CAPACITY

2.1. To access the Resources provided by Purple Feather Tree details of the digital products will have been offered across the public domain for general consideration of those who engage with details and representations made relating to the digital products we offer.

2.2. Our offers will provide full details of the cost, any promotions and any ‘try before you buy’ trial offers.

2.3. On acceptance of an offer for any of our online digital courses including any introductory trial module, you will be entering into a contract and payment will fall due either in full or by way of any payment plan that may be offered in accordance with 4 and 5.

3. DIGITAL PRODUCTS

3.1. Purple Feather Tree provides good quality non-tangible Digital Products that are supplied by way of digital access.

3.2. When you have accessed and initiated the learning process then you will have initiated a waiver (i.e.: the right will no longer apply) of your statutory cancellation rights. This is because:

3.2.1. Once the digital resource has been accessed, the educational benefits and learning will have been released and it will not be possible to return the product to Purple Feather Tree unused.

3.3. We aim to comply with relevant statutory provisions to ensure that we provide the best service to our clients, however, as our products and services are digital all requests for refunds are dealt with on a case-by-case basis. It is the case that no refunds will be given once the product/s have been accessed.

4. DESCRIPTION, QUALITY AND PURPOSE

4.1. Our digital products are described fully to include the price of the product and all other relevant information.

4.2. The digital products are specifically designed to be provided digitally and to be accessed online in the form of educational modules, free of minor defects, safe and durable.

4.3. As with any digital product there may from time to time be negligible technical defects that will not constitute a breach of this Agreement.

4.4. We provide information about our products prior to contracting and on occasion offer samples of the product.

4.4. This agreement does not include any express terms about the quality of digital content or fitness for purpose except where the statutory requirements relating to description, satisfactory quality and fitness for purpose apply as provided 4.1 to 4.4

5. PAYMENT OF ONE-OFF SET FEE

5.1. You agree to pay, and authorize PayPal and Stripe, our third-party payment processor to charge your account using your selected payment method and/or payment plan. Payment taken will be for all applicable fees and taxes that may accrue in relation to your plan to use our digital products and services.

5.2. All fees are in US Dollars and are non-refundable except as required by law and as referenced at 2. Purple Feather Tree is not responsible for any third-party charges that you may incur such as bank fees, foreign exchange rates applied by your Credit Card Company and/or financial institution. You are responsible for providing complete and accurate billing and contact information to us.

6. PAYMENT PLANS

6.1. Some digital products may be provided by way of a monthly payment plan. This plan is not a credit agreement, it is a payment plan that allows you full access to the products provided on a goodwill payment plan basis. Failure to make all payments once you have downloaded and accessed a digital product will be a direct breach of any payment plan and will result in accruing due payments and overdue liability for the full and final settlement of the payment plan.

7. SUBSCRIPTION TRANSACTIONS

7.1. If you choose a monthly or membership product or service, the amount payable will be collected automatically every 30 days until such time as you unsubscribe from the service. Details of how to cancel membership are assessable through your online account settings and billing menu. To ensure that you are not charged post- cancellation you should allow no less than 5 days cancellation notice.

8. REFERENCE TRANSACTIONS

8.1. A reference transaction is a financial transaction from which subsequent transactions can be derived. PayPal Reference Transactions & <> are used to make to make subsequent transactions to offer you additional offers at checkout.

8.2. These offers are optional, you will be provided the option to opt-out of any after purchase offers by clicking the “No Thanks, I won’t see this offer again and I am not interested” option. After adding your payment information at checkout, you agree to allow our payment processor to store an authorization for additional payments where you have selected to continue with the addition of further products and services.

9. REFUNDS

9.1. The products and service we provide of non-tangible digital products as shown at 2. If you believe you have a genuine basis to request a refund you must be able to evidence that you have completed the program and can only request the refund after this time.

9.2. Refunds are not given because:

9.2.1. After accessing the product you changed your mind;

9.2.2. After accessing the product found the plan unsuitable;

9.2.3. You did not have access to the required equipment;

9.2.4. You found the product confusing,

9.2.5. You had a technical issue that relates to your device.

9.3.  There may, in exceptional cases be occasions when we will consider a request for a refund for example where you are able to evidence a situation whereby it is wholly unlikely that, as a result of a significant trauma you cannot reasonably be expected to access or utilise the product provided.

9.4. Due to the digital nature of our products these terms are without exception and a refund request outside of these requirements will not be possible.

9.5. The courses we provide require a commitment to spend time reading and formulating your plan. Every course requires some personalization and time commitment. This refund policy is the standard terms for online, digital products. Unlike physical products, once you have purchased this product you will have instant access to the files and cannot return them.

9.6. Please do not contact us for a refund if you have not tried the program and completed it. For example, if you are engaging in one of our online digital courses you will be able to access a check list after each module to indicate that you have applied the knowledge in some way. If we find that you completed all the modules and checks lists and have evidence that supports that you did not make any progress, we will contact you to consider your outcomes and your case before making our final decision.

In the event of a dispute arising between the parties that the parties are unable to resolve concerning this agreement or any the provision of the services provided, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration conducted by the LCIA Arbitration and ADR Worldwide.

Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by either Alternative Dispute Resolution or Arbitration under the LCIA Rules, which Rules are deemed to be incorporated by reference into this clause.

21.3.The number of arbitrators shall be One (1).

21.4. The seat, or legal place, of arbitration shall be London, United Kingdom.

21.5. The language to be used in the arbitral proceedings shall be English.

21.6. The governing law of the contract shall be the substantive law of the United Kingdom.

As each country has laws that may differ from those in the UK by accessing our website, you agree that the statutes and laws of the United Kingdom will apply to all matters relating to the use of our website and the purchase of any products or services through this site.
